The Federal Trade Commission's (FTC) referral of a complaint against TikTok and its parent company ByteDance to the Department of Justice (DOJ) marks a significant escalation in the ongoing scrutiny surrounding the popular video-sharing app. This move raises concerns about child privacy and reignites the debate about national security risks potentially posed by TikTok's Chinese ownership.

The FTC alleges that TikTok may be violating the Children's Online Privacy Protection Act (COPPA) by collecting data from users under 13 without parental consent. COPPA safeguards the online privacy of children by requiring websites and apps to obtain verifiable parental consent before collecting, using, or disclosing personal information from children under 13.  This isn't a new issue for TikTok. In 2019, Musical.ly, the app TikTok is essentially an evolved version of, settled similar COPPA violations with the FTC for a hefty $5.7 million. 

While the FTC hasn't revealed the specifics of their investigation, the referral suggests they believe TikTok may be engaging in practices similar to those that led to the Musical.ly fine. This could include collecting data like location, browsing history, and even video content from underage users without proper parental authorization.  

However, TikTok maintains its innocence. The company refutes the FTC's allegations, claiming they've been working with the commission to address concerns and that many of the accusations are based on "outdated practices." This raises questions about the nature of the alleged violations.  Are they truly historical issues addressed by TikTok, or are they ongoing practices that warrant a stronger response from the DOJ?

The FTC's decision to publicize the referral, a departure from their usual protocol, suggests they view this as a serious matter with significant "public interest." This could indicate the potential for hefty fines or even stricter data collection limitations imposed on TikTok if the DOJ pursues the case.

The situation becomes even more complex when national security concerns are factored in. In April, the US passed a law requiring TikTok to be sold to a US-approved buyer due to fears that the Chinese government could potentially access user data and potentially influence content. Both TikTok and ByteDance are currently challenging this law in court.

The FTC's referral adds another layer of pressure to TikTok. With child privacy concerns now intertwined with national security anxieties, the pressure for the company to address data collection practices and potential security risks is immense.  

Some potential consequences of the DOJ taking on this case include increased scrutiny. The DOJ's involvement will likely lead to a more thorough investigation of TikTok's data practices. Expect a deeper dive into how user data is collected, stored, and potentially accessed by ByteDance or the Chinese government. 

If the DOJ finds evidence of COPPA violations, significant fines could be imposed on TikTok. Additionally, the court might impose limitations on how TikTok collects and uses user data, particularly from children.

The most drastic outcome would be a court order enforcing the sale of TikTok to a US-approved buyer or even a complete shutdown of the app in the US. While unlikely,  this outcome cannot be entirely ruled out. 

The coming months will be crucial for both TikTok and the US government. How the DOJ proceeds with the FTC's complaint and the ongoing legal battle concerning the forced sale will determine the fate of TikTok in the US. 

The outcome will not only impact the future of the app but also set a precedent for how the US handles the data privacy concerns surrounding powerful tech companies with foreign ownership.
