Cristina Balan, a former Tesla engineer who blew the whistle on potential safety risks, has won a pivotal legal victory against Elon Musk and Tesla, as the U.S. Court of Appeals for the Ninth Circuit reversed a lower court ruling and reopened her long-running defamation case.
Balan, once a key figure within Tesla with her initials engraved on Model S battery packs, was dismissed in 2014 after raising concerns about curled floor mats potentially interfering with vehicle braking. Following her dismissal, Tesla publicly accused her of using company resources for a "secret project"—allegations she says amounted to embezzlement and severely damaged her reputation.
She filed a defamation lawsuit in 2019, but her claims were dismissed in arbitration due to California’s statute of limitations. A district court upheld that decision. Now, the Ninth Circuit has ruled that the lower court lacked jurisdiction to confirm the arbitration outcome, effectively giving Balan a fresh opportunity to pursue her claims.
“This brings us back to square one,” Balan said in a statement to BBC News. “We’re hoping to launch a new lawsuit and finally face Elon Musk in front of a jury.”
Balan’s legal battle has been deeply personal. She has previously shared that she is in remission from stage-3B breast cancer, and her motivation to clear her name is driven by her son. “I just want the truth to be heard, and I wish Elon Musk had the decency to apologize,” she told the BBC.
Tesla has yet to comment on the court's decision.
Legal experts say the case could become a defining moment for corporate whistleblowers, potentially encouraging others to speak up despite powerful opposition. As Balan prepares for a renewed legal fight, the tech world is watching closely to see if the case will finally bring Elon Musk to court.
